Acceptance of Terms

By accessing or using bleuallusion.com, shop.bleuallusion.com, or any Bleu Allusion platform (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Platform.

These Terms constitute a legally binding agreement between you and Bleu Allusion Group LLC ("Bleu Allusion," "we," "us," or "our"), a Georgia limited liability company. You must be at least 18 years old to make a purchase.

The Platform

Bleu Allusion operates:

• bleuallusion.com — the main brand website featuring editorial content, brand stories, and platform access
• shop.bleuallusion.com — the Shopify-powered storefront for purchasing products from Bleu Allusion's house brands (S2, Soul & Spirit, Sun & Shade)
• The Nunua Marketplace — a curated online marketplace connecting independent African artisan brands and vendors with customers globally
• SEMA — an editorial publication featuring stories, interviews, and cultural commentary

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time with reasonable notice to registered users.

Accounts

Certain features require you to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and not share it with others
• Notify us immediately of any unauthorized use of your account at [email protected]
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for an extended period.

Purchasing & Orders

When you place an order on the Platform, you are making an offer to purchase the selected items. Your order is accepted and a contract is formed when we send you an order confirmation email.

We reserve the right to:

• Refuse or cancel any order at our discretion, including for suspected fraud
• Limit quantities of any item per order or per customer
• Correct pricing errors and cancel orders placed at incorrect prices (with full refund)
• Discontinue any product without notice

Product descriptions, images, and specifications are provided in good faith. Colors may appear differently across devices. We are not responsible for minor variations between product images and received items.

Pricing & Payment

All prices are displayed in US Dollars (USD) unless otherwise specified. Prices are subject to change without notice.

We accept payment through:

• Major credit and debit cards (Visa, Mastercard, American Express) via Shopify Payments
• M-Pesa, Airtel Money, and other East African mobile money services via Pesapal
• Other payment methods as displayed at checkout

By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge the full amount of your order.

You are responsible for any applicable taxes, duties, or customs fees associated with your order. International orders may be subject to import taxes in your country.

Shipping & Delivery

Estimated delivery times are provided at checkout and in your order confirmation. These are estimates only and are not guaranteed. Bleu Allusion is not responsible for delays caused by carriers, customs authorities, or circumstances beyond our control.

Risk of loss and title for items pass to you upon delivery to the shipping carrier. We strongly recommend purchasing shipping insurance for high-value orders.

For Nunua Marketplace orders, individual vendors are responsible for fulfilling and shipping their products. Shipping times may vary by vendor location. See the full Shipping & Returns Policy for details.

Returns & Refunds

Our full Returns & Refunds policy is available at shipping-returns.html. In summary:

• Standard items — returnable within 14 days of delivery, unworn with original tags attached
• Custom, made-to-order, and sale items — final sale, no returns or exchanges
• Defective items — contact us within 7 days of delivery for replacement or full refund
• International returns — customer is responsible for return shipping costs and any duties

Refunds are processed to the original payment method within 5–10 business days of us receiving the returned item in acceptable condition.

Nunua Vendor Terms

Vendors ("Sellers") on the Nunua Marketplace are independent businesses, not employees or agents of Bleu Allusion. By applying to and selling on Nunua, you agree to:

Eligibility & Onboarding

• Provide accurate business information and documentation during the vendor application process
• Maintain compliance with all applicable laws in your jurisdiction, including tax registration
• Only list products that you have the right to sell and that comply with our vendor content guidelines

Listings & Products

• All product descriptions must be accurate and not misleading
• Products must be authentic, handmade or artisan-quality consistent with the Nunua brand standard
• You are responsible for maintaining accurate stock levels and pricing
• Bleu Allusion reserves the right to remove any listing at its discretion

Commissions & Payouts

• Bleu Allusion retains a commission on each sale as specified in your vendor agreement
• Payouts are processed on the schedule set out in your vendor agreement (typically monthly)
• Bleu Allusion may withhold payouts to cover returns, chargebacks, or policy violations

Fulfillment

• Vendors are responsible for fulfilling orders within the timeframe committed at listing
• Failure to fulfill orders will result in mandatory refunds and may result in account suspension

Intellectual Property

All content on the Platform — including text, photographs, logos, graphics, product designs, and software — is owned by or licensed to Bleu Allusion and protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, or commercially exploit any Platform content without our express written permission.

SEMA editorial content may be shared for non-commercial purposes with attribution to "SEMA — Bleu Allusion" and a link to the original article.

Vendors retain ownership of their product photography and brand assets. By listing on Nunua, you grant Bleu Allusion a non-exclusive, royalty-free license to use your product images and descriptions for Platform operation and marketing.

Prohibited Conduct

You agree not to:

• Use the Platform for any illegal purpose or in violation of any applicable law
• Attempt to gain unauthorized access to any part of the Platform or its related systems
• Use automated means (bots, scrapers) to access the Platform without our prior written consent
• Submit false, misleading, or fraudulent information in any form
• Harass, threaten, or harm any other user, vendor, or Bleu Allusion staff member
• Post or transmit content that is defamatory, obscene, or infringes third-party rights
• Attempt to circumvent payment systems or charge-back legitimate transactions fraudulently
• Sell counterfeit, stolen, or prohibited goods on the Nunua Marketplace

Violation of these prohibitions may result in immediate account termination, reporting to law enforcement, and civil legal action.

Disclaimers

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, BLEU ALLUSION DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content on the Platform.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BLEU ALLUSION'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO BLEU ALLUSION IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

IN NO EVENT SHALL BLEU ALLUSION BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of the Platform shall first be submitted to good-faith negotiation. If not resolved within 30 days, disputes shall be submitted to binding arbitration in Atlanta, Georgia, under the rules of the American Arbitration Association.

Class action waiver: You agree to resolve disputes with Bleu Allusion on an individual basis only, and not as part of any class or representative action.

Nothing in this section prevents either party from seeking injunctive or other equitable relief from a court to prevent ongoing harm.

Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email to registered users at least 14 days before taking effect, and by a prominent notice on the Platform.

Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the Platform.
